The parents of a toddler who was severely injured when he was struck by a car near his home’s mailbox has confidentially settled a lawsuit against the car’s driver for $125,000, the family’s attorney reports.
Malcolm Crosland Jr. of Steinberg Law Firm in Charleston reports that the three-year-old and his father were in their backyard in July 2019 when the father went to check the mailbox, which stood beside the road in front of their house. Unbeknownst to the father, his son ran from the back yard to follow him and was standing just to the side of the road when the driver maneuvered off the road in order to avoid a parked car and ran over the boy.

The toddler suffered abrasions to the head, laceration of his liver, a fracture of left clavicle, and multiple rib fractures. He had part of his liver removed and was in the hospital for about three weeks, Crosland said.
“Nobody was quite sure he was going to make it, but he stabilized and no longer needed to be on a ventilator,” Crosland said.
The driver contended that the toddler was in the road, but Crosland said that the toddler was standing between the curb and the street.
“He seems to be doing much better,” Crosland said. “He still has some PTSD issues and some speech-related issues, but he does not seem to have any ongoing pain.”
The firm said that the $125,000 settlement reflected the limit of all available insurance coverage.
Due to a confidentiality agreement, other details about the settlement, including the location of the incident and the identities of the driver and the defense counsel, were unavailable.
